Endless Coloring FX — Terms of Use

1. Who we are

FaceyIT FZ-LLC ("we", "us"), Compass Building, Al Shohada Road, Street C – Al Hamra Area, Ras Al Khaimah, United Arab Emirates. Contact: support@endlesscoloring.app.

These Terms govern your use of the Endless Coloring FX app for iOS, iPadOS and Android (the "App"). Our other app, Endless Coloring, has its own terms; they do not apply to the App. How the App handles data is described in the Privacy Policy.

2. Who may use the App

The App is made for children aged 2–8 and is meant to be used under the supervision of a parent or legal guardian. Purchases and settings are made by an adult (18+): they are in the For parents section, behind a parental gate. By making a purchase you confirm that you are an adult and that you agree to these Terms.

3. Free part and subscription

• Free effects. Some effects can be used for free, with no time limit and no subscription. The App shows which ones.
• Daily free try. Every day each paid effect can also be tried for free for a short time. The App shows how much of today's try is left. Which effects are free and how long the try lasts may change over time; the App always shows the current state.
• Subscription. A subscription opens all effects for as long as it is active. There is a monthly plan and a yearly plan.
• Free trial. The yearly plan includes a 7-day free trial for first-time subscribers. The store shows whether the trial applies to you before you confirm. If you do not cancel before the trial ends, the yearly subscription starts and is charged.
• Price. The price and currency are shown by the App Store or Google Play before you confirm the purchase, and may differ by country.
• Automatic renewal. A subscription renews automatically for the same period until you cancel it. The store charges your store account when you confirm the purchase (with a free trial — when the trial ends) and at each renewal. On the App Store, a subscription renews unless it is cancelled at least 24 hours before the end of the current period.
• Family Sharing. On the App Store the subscription can be shared with your family through Apple Family Sharing.
• Another device. Because there is no account, the subscription belongs to your Apple ID or Google account. On a new device, use Restore purchases in the For parents section.

Cancellation

Cancelling stops the next renewal; access remains until the end of the paid period. Deleting the App does not cancel a subscription — cancel it in the store.

Refunds and right of withdrawal

Payments are made to Apple or Google, so refunds are handled by Apple or Google under their policies — we cannot issue them ourselves. For consumers in the EU/EEA and the UK, the right of withdrawal for purchases in the App Store or Google Play follows the rules of Apple and Google. Your statutory rights if the App is faulty are not affected.

4. Health and safety

Some effects use bright colours, movement and flashes. The For parents section has a Soft flashes setting that makes them gentler. If your child has photosensitive epilepsy or has ever reacted to flashing light, talk to a doctor before use. Please take breaks and keep an eye on screen time.

5. Content and licence

The App, its effects, sounds, music and design belong to FaceyIT FZ-LLC or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the App on devices you own or control, for personal, non-commercial use, in line with the rules of the store you got it from. Do not copy, resell, reverse-engineer or modify the App, and do not try to bypass the subscription.

6. Availability and changes

We work to keep the App working well, but we do not promise uninterrupted or error-free operation. We may add, change or remove effects and features, and change which effects are free or how long the daily try lasts. If we change these Terms materially, we will publish the new version on this page before it takes effect.

7. Disclaimers and liability

The App is provided "as is". To the fullest extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited by law (including liability for fraud or for death or personal injury caused by negligence). Where our liability is not excluded, it is limited to the amount you paid for the App's subscription in the 12 months before the event.

8. Ending use

You may stop using the App at any time by deleting it; this also removes everything the App stored on the device. Remember to cancel an active subscription in the store. We may stop offering the App; an active subscription then stays usable until the end of its paid period, or the store refunds it under its rules.

9. App-store specific terms

If you obtained the App from the Apple App Store: this agreement is between you and FaceyIT FZ-LLC only, not with Apple. Apple has no obligation to provide support or maintenance for the App. Apple is not responsible for any claim relating to the App, and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Similar principles apply to Google Play.

10. Governing law

These Terms are governed by the laws of the United Arab Emirates, and the courts of Ras Al Khaimah have jurisdiction — without depriving consumers of the mandatory protections of the law of their country of residence.
